NDS Wins Arbitration against Skanska over Sitina Tunnel

BRATISLAVA, May 6, (WEBNOVINY) — The National Highway Company, a.s. (NDS) has won another international arbitration against the Czech company Skanska DS, a.s. seated in Brno. The International Court of Arbitration of the International Chamber of Commerce in Paris ruled in favor of the highway company and rejected in the full extent the claim of Skanska DS for the settlement of exchange rate differences. “The differences occurred during construction of the D2 highway section Lamacska Cesta – Stare Grunty, which is known as Sitina Tunnel to the public. The claimed amount exceeded EUR 12.5 million,“ NDS spokeswoman Nora Gubkova informed SITA news agency. “We fully accept the ruling of the Court of Arbitration,“ stated Skanska for SITA news agency.

Skanska DS has been claiming the settlement of exchange rate differences for extra works, which it provided within construction, for three years. The International Court of Arbitration of the International Chamber of Commerce in Paris turned down the claim on March 17. “This is the second success of NDS in the arbitration process concerning the same construction. A year ago, on April 23, 2010, the very same court ruled out the claim of the company Taisei for payment of exchange rate differences. The Japanese company, which constructed the Sitina Tunnel, had claimed almost EUR 22 million from NDS since the end of 2007,” added Gubkova. NDS won both arbitration processes totaling over EUR 34 million and the company received back all costs that incurred in connection with arbitration proceedings.
